The full and controlling Acceptable Use Policy is posted at https://legal.smrtpayments.com/guest-wifi.html By connecting to the SMRT Payments guest wireless network (the Guest Network), you agree to be bound by this policy. If you do not agree, do not connect. 1. SCOPE. The Guest Network is provided as a courtesy for incidental, lawful internet use during your visit. It is separate from SMRT Payments internal systems. No access to internal networks, applications, or data is granted or implied. 2. MONITORING. SMRT Payments may log, monitor, inspect, filter, and retain all traffic for security, operational, and legal compliance purposes. You have no expectation of privacy. Logs may be disclosed to law enforcement or other parties under valid legal process. 3. PROHIBITED USE. You may not use the Guest Network to violate any law, transmit or access unlawful, harassing, obscene, or infringing content, distribute malware, conduct scanning, intrusion, denial of service, or other unauthorized security testing, circumvent any security control, impersonate others, send spam, mine cryptocurrency or saturate bandwidth, run unauthorized servers, proxies, anonymizers, or VPN exit nodes, transmit cardholder data, PHI, or other regulated data, or interfere with the network or other users. 4. NO ACCESS TO PRIVATE SYSTEMS. The Guest Network is the only resource available to you. Any attempt to access, probe, scan, enumerate, or pivot to any non Guest SMRT Payments network, system, account, or device is strictly prohibited and is not authorized for any purpose. Private systems may contain confidential, privileged, regulated, and cardholder data. SMRT Payments reserves all rights and remedies under the Computer Fraud and Abuse Act (18 USC 1030), the Defend Trade Secrets Act (18 USC 1836), the Stored Communications Act, the Wiretap Act, Washington computer trespass statutes (RCW 9A.90), Washington trade secret law (RCW 19.108), and other applicable law, including damages, injunctive relief, attorneys fees, and referral to law enforcement. 5. AS IS, NO WARRANTY. The Guest Network is provided AS IS and AS AVAILABLE, without warranty of any kind. SMRT Payments does not guarantee availability, security, or fitness for any purpose. You are solely responsible for the security of your own device and data. 6. LIMITED LIABILITY. To the maximum extent permitted by law, SMRT Payments and its officers, members, employees, and affiliates are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Guest Network. 7. INDEMNIFICATION. You agree to defend, indemnify, and hold harmless SMRT Payments from any claim, loss, or expense (including attorneys fees) arising from your use of the Guest Network or your violation of this policy. 8. TERMINATION. SMRT Payments may suspend or terminate your access at any time, for any reason, with or without notice. 9. GOVERNING LAW. This policy is governed by the laws of the State of Washington.
